These Terms and Conditions (hereinafter, the \u201cTerms<\/strong>\u201dregulate access and use of the website\u00a0www.laboratoria.la<\/a>\u00a0and of the mobile application (jointly or individually, the \u201cPlatform<\/strong>\u201d), as well as the transactions related to the products and\/or services offered therein, regardless of the digital media, technological support, or device through which it is accessed. The Platform is managed and made available by LABORATORIA (\u201cLaboratoria<\/strong>\u201do\u201cwe<\/strong>\u201d), with email address\u00a0comunicaciones@laboratoria.la<\/a>.<\/p>

We kindly ask you to read these Terms carefully, as well as the Privacy Policy applicable to the Platform, before using it. Accessing, browsing, or using the Platform, as well as requesting any service through it, implies your express acceptance and consent to be legally bound by these Terms and the corresponding Privacy Policy. If you do not agree with what is established herein, please refrain from using the Platform.<\/p>

IMPORTANT:<\/strong>\u00a0These Terms contain essential provisions regarding your rights, obligations, and remedies in connection with the use of the Platform and the services provided through it, including various limitations of liability and exclusions described below.<\/p>

I. Acceptance of the Terms and Conditions<\/h5>

These Terms constitute a legally binding agreement between you and Laboratoria, setting forth the rights, obligations, and remedies derived from accessing, browsing, interacting with, and conducting transactions through the Platform (the \u201cServices<\/strong>\u201do\u201cPlatform Services<\/strong>\u201d). If you are acting on behalf of your employer or another legal entity, you hereby represent and warrant that: (i) you have sufficient legal capacity and authority to validly bind such entity in accordance with these Terms; (ii) you have read and fully understood these Terms; and (iii) you agree, on behalf of the entity you represent, to be bound by the provisions hereof.<\/p>

By accessing, registering for, or using the Services, you (hereinafter, the \u201cUser<\/strong>\u201d) acknowledges having read, understood, and agreed to be legally bound by these Terms, as well as Laboratoria's Privacy Policy, which governs the collection, use, and processing of their personal data.<\/p>

Given Laboratoria's presence in various countries, the platform may contain specific sections directed exclusively at female users residing in those territories where Laboratoria operates. Such sections will be drafted in strict compliance with applicable local regulations. For this reason, we kindly ask you to review, in addition to these terms, the Privacy Policy and the sections corresponding to each country, available in the\u00a0next link<\/a>.<\/p>

II. Privacy<\/h5>

At Laboratoria, we are aware of the importance that privacy holds for our Users. The processing of personal data collected through access to or use of the Platform shall be governed by the provisions of our Policy\u00a0<\/strong>of Privacy, which forms an integral part of these Terms by its incorporation by reference. We invite you to consult said Policy\u00a0<\/strong>of Privacy, available on the Platform, in order to know in greater detail the manner in which Laboratoria collects, uses, protects and, where appropriate, shares your personal information.<\/p>

III. Right to Use the Services<\/h5>

The Services offered through the Platform are directed exclusively to persons over eighteen (18) years of age. Consequently, minors may not access or use the Services.<\/p>

In the event that a minor has provided personal information on the Platform, their parent or legal guardian may request the deletion of such information from our records by sending an email to\u00a0privacy@laboratoria.la<\/a>. Once the request is received, Laboratoria will make reasonable and legally permissible efforts to delete the corresponding information.<\/p>

IV. Representations and Warranties to Laboratoria\u00a0<\/h5>

By using this platform, you expressly represent and warrant that you are legally authorized to enter into this Agreement and that you have the right, power, and capacity to enter into this Agreement and comply with the Terms and Conditions thereof.\u00a0<\/p>

By using this platform and interacting through it, you agree to:<\/p>

  1. Use this platform solely for lawful purposes.<\/li>
  2. Provide us with your true and accurate email address, postal address, and\/or other contact information. You also consent to our use of this information to contact you if necessary (see our Privacy Policy).\u00a0<\/li><\/ol>
    V. Accounts and Registration\u00a0<\/strong><\/h5>

    Access to certain Services or functionalities of the Platform may be available without the need to create an account or register. However, to use certain Services, the creation of a User account may be required. Upon registering, you agree to:<\/p>

    1. Provide truthful, complete, accurate, and up-to-date information regarding your identity and\/or the user registering during the account creation process.<\/li>
    2. Keep this information up to date, correcting or supplementing it as necessary in order to preserve its truthfulness and accuracy.<\/li>
    3. Maintain the confidentiality of your access credentials (username, password, and any other associated data) and refrain from disclosing them to third parties.<\/li>
    4. Assume full responsibility for all activities conducted from your User account, regardless of whether you have authorized them or not.<\/li>
    5. Notify Laboratoria immediately of any unauthorized use of your account, loss, theft, or improper access to your credentials.<\/li><\/ol>

      Failure to comply with any of the foregoing obligations shall constitute a violation of these Terms and may result in the immediate suspension or termination of the corresponding User account.<\/p>

      Account Information Restrictions<\/h5>

      You may not choose or use a user name, identifier, or access credential that: (i) corresponds to another person's name with the intent to impersonate them; (ii) infringes the rights of third parties without proper authorization; (iii) falsely suggests a relationship, connection, or association with Laboratoria; or (iv) in Laboratoria's sole discretion, is offensive, vulgar, or inappropriate. Laboratoria reserves the right to refuse registration or cancel any User account that violates these provisions.<\/p>

      Suspension or termination of access<\/h5>

      Laboratoria may, at its sole discretion and without prior notice, suspend, restrict, or cancel a User's access to the Services, as well as deactivate or delete the corresponding account, in the event of a breach of these Terms or when, in Laboratoria's judgment, such measure is deemed necessary or justified. Laboratoria also reserves the right to revoke access to the Platform at any time, with or without just cause.<\/p>

      Voluntary account cancellation<\/h5>

      The User may cancel their account or access to the Services at any time, either through the functionality enabled on the Platform itself or by means of a request sent to Laboratoria via the email address sumate@laboratoria.la. Once the account is canceled, Laboratoria may retain your information and content for the time required to comply with obligations arising from applicable legislation and our legal relationship.\u00a0\u00a0<\/p>

      VI. User Conduct<\/h5>

      As a condition for accessing and using the Platform and its Services, the User agrees not to use them for: (i) unlawful purposes; (ii) purposes expressly prohibited in these Terms and Conditions; or (iii) purposes other than those that Laboratoria considers reasonable, customary or compatible with the purpose for which the Platform was created.<\/p>
